TERMS & CONDITIONS
Please read the following terms and conditions carefully.

In the following terms & conditions “we" shall refer to Cruz Studios. These terms & conditions cannot be varied in any way by the clients, unless such conditions are expressly agreed in writing.
​
THE AGREEMENT
​
In the case of studio based shoots, the client agrees to supply products and populate a brief with sufficient time to allow for the sourcing of any props and ingredients that might be required for a shoot. If the product does not arrive or a brief has not been completed on time, the shoot may be delayed or cancelled and the client may be subject charges.

CANCELLATION & POSTPONEMENTS
​
Please note that postponements and date movements are also part of this cancellation policy.

Once the client has made a booking for a specific time and date, Cruz Studios will not accept any other work from other clients for those times and dates.

As a result, once a booking is made, if it is subsequently cancelled or postponed, a cancellation fee will be charged to the client, according to the following schedule:
- When a client cancels or postpones a booking within two weeks of any confirmed date, a fee of 50% of the booked time rate will be charged.
- When a client cancels a booking within one week of any confirmed date, a fee of 100% of the booked time rate will be charged.

In addition to these cancellation fees, the client will be charged for any expenses already incurred by Cruz Studios, for example food/drinks, props and models.

THE BRIEF

We are happy to contribute our own creative ideas but the client is ultimately responsible for populating a working brief. This must be clear and contain all necessary information for the shoot.

If you have a specific vision in mind, please include detailed instructions and reference images in the brief. A picture speaks a thousand words and will help us to see what you have in mind.

If information is missing from the brief and a reshoot and/or edit is required this will be at an additional cost to the client.

Any reshoots due to an unclear brief, or a change of mind on the client's part, will be at an additional cost to the client.

If you mention anything to us via email or phone please add it to the brief to ensure it is included.

DEPOSITS
​

A 50% deposit may be required prior to the shoot to confirm a booking. This will be deducted from the final invoice or fully refunded if a cancellation/postponement occurs within the 'cancellation' terms above.

PROPS AND FOOD
​​

We have a well equipped studio with a variety of props, but if a project requires other props we will ask the client to source and send them along with their product(s). If this is not possible, then props should be sent to the studio address in advance of the booked shoot day(s), Alternatively, props can be outsourced by Cruz Studios at the clients expense and a deposit will be required to cover the costs before purchase.

Shoots requiring simple food props or flavour cues will be sourced locally and invoiced back to the client. For more complex setups which require larger quantities of food, out of season ingredients or complex recipe prep, the client will need to send these directly to Cruz Studios.

DELIVERY
​
Cruz Studios will deliver digital files via Dropbox within 7 days of the shoot, unless otherwise specified.

PAYMENT SCHEDULE
​
Payment in full is to be made no later than 14 days after the content is delivered. Failure to make the payment within this period will result in a late payment fee, plus statutory interest (8% plus current Bank of England base rate):

Extra £40 fee to be added for debts less than £1000 (plus statutory interest)

Extra £70 fee to be added for debts between £1000 - £10,000 (plus statutory interest)

Extra £100 fee to be added for debts more than £10,000 (plus statutory interest)

If the full payment, including late payment fee, has not been made within 7 days of the notice, further action will be taken. This will begin with a mediator but if unsuccessful will be followed by court action.

COPYRIGHT & LICENSING AGREEMENT
​​
1 - Cruz Studios Photography holds the ownership and copyright to all content produced by Cruz Studios Photography, as per copyright law, under the Berne Convention.
2 - The standard day rate charged by Cruz Studios Photography grants UK use in perpetuity and distribution of the content to third parties. Both licensee(s) and third parties do not have the right to edit any content produced by Cruz Studios Photography, unless granted upon written agreement with the licensor.
3 - Content produced by Cruz Studios Photography can be used across all social media platforms, licensee(s) websites and for any purposes of advertising. The use of content for other usage, such as TV and publishing (e.g. the selling of prints, use of prints in books), may be granted upon written agreement with the licensor; additional fees will apply.
4 - If the client wishes to use the content in one or more countries outside of the UK an additional usage and licensing fee will apply.
5 - If an alternative amount of copyright is required, other than those mentioned above, then our packages start at £2,000. However, this is subject to change based on specific requirements; this will be discussed and agreed in writing before the shoot takes place.

DISPLAY
​
Cruz Studios may display any creative content created during for promotional purposes, social media and website/online portfolios, unless agreed otherwise in writing.

POST-PRODUCTION AND EDITING
Basic edits and retouching are included in our prices but please be aware that in the case of studio-based product shoots, items will be shot in the condition we receive them. If we receive a product and/or its packaging in a damaged condition which requires retouching this will be at an additional cost to the client.
STUDIO HIRE
1. Agreement - The following represents the agreement between Cruz Studios and the Client
2. Booking & Cancellation:

Once both Cruz Studios and the Client have agreed a date in writing, a booking is considered confirmed, and the date reserved.

Confirmed bookings, when cancelled within 24 hours of the shoot date, will be charged at at 50% of the booked time.

If, due to unavoidable reasons, for example injury or illness, Cruz Studios needs to reschedule a booking, then every effort will be made to do so for a mutually suitable time.
3. Deposit & Payment

A equipment/ damage deposit of £100 will be required to confirm the booking. ( fully refundable if
no damage is made to the equipment, A further penalty may be put into place if the equipment
damaged is worth more than the deposit, please see 6.)

Full Payment ( deposit & Hire) will need to be made up to 24 hours prior to the booking to
secure/confirm your booking, unless otherwise agreed, in writing, prior to the commencement of
the booking.

Payment will be made via bank transfer/payment with an invoice.
4. Set-up/Take-down - The client must allow for set-up and take-down times, which are charged at regular studio hire rates.
5. Use of equipment (if required)

Equipment must only be used by those competent in its operation. Proficiency must be demonstrated prior to a client’s unassisted use of equipment.

No studio equipment may, without permission, be removed from the studio, modified, or used in amanner other than recommended by the manufacturer.

All studio equipment must be returned at the conclusion of the hire period in its original condition.

A full equipment check will be carried out before, and after every session.
-
Consumable items used (paper backgrounds etc…) will be charged at cost.
-
Any breakage must be immediately reported.
6. Breakages/Loss/Damage
The client is responsible, and agrees to pay in full, for any breakage, loss or damage caused to the
studio or studio equipment by any person connected with the shoot.
Cruz Studios will not be held responsible for any loss/accidental damage or injury sustained while using the
studio or equipment.
7. Stock/lost Property
To prevent accumulation of uncollected items, any products must (unless otherwise mutually
agreed) be left with Cruz Studios for no longer than 14 days from the date of a completed shoot. After this
time, stock will be disposed of, or donated to charity.
Notes
-
No smoking is permitted anywhere in the studio.
-
We have a whippet in the studio, but no other pets are allowed in the studio.
-
Children and minors must be accompanied by an adult at all times.
-
It is recommended that clients have their own public liability insurance. Cruz Studio’s insurance does not cover clients hiring the studio.

LIABILITY LIMITATIONS ​
​
In the event that we are unable to deliver content for any reason, such as injury, illness, acts of God or loss of digital files, we will offer to reschedule the shoot or, where this is not possible, issue a full refund to the client. ​​
